This Disclaimer is including, but not limited to How-To and Instructional Content provided in, but not limited to, the form of Articles, Guides, Instructions, Standard Operating Procedures, Checklists and covers all formats, including Conversations, Audio Recordings, Video, Livestreams, Written Posts, Written Articles, Newsletters, Emails, Downloadable PDFs, Course Content that is either Free or Paid and any other applicable formats that Vesper Digital Media or Digital Codec may produce, distribute and/or sell such information now or in the future.


All information and content created by Vesper Digital Media and Digital Codec is provided in an as-is state with no guarantees for accuracy, effectiveness, monetary results or specific outcomes. We do our professional due diligence to check the quality of all information we share both in our client work and in the content that our team produces and distributes. It is all provided in our professional opinion and with good intentions, but is not infallible especially if applied to an outlier use case where it is not a proven method.

Platforms, programs, tools, information and other factors can change with zero notice and be outside both the end users control as well as our own. Either due to them not being maintained directly by us, or unforeseen interruptions in service, mechanical or technical failure, acts of god, etc. Vesper Digital Media and Digital Codec are not legally responsible for fixing, updating or tracking everything actively at all times especially 3rd party services and any damages incurred are not our responsibility and we will not be held liable.


For our own platforms, information products etc. we will do our due diligence in maintaining and updating them to ensure accuracy and minimize time offline.  If something unexpected happens that causes a disruption in service we will not be held liable for any losses caused by loss of service. We will do our best to bring everything back online as soon as possible, notify users if scheduled updates are coming up to ensure they are aware of planned down time and keep our user base informed as appropriate and as information and updates are available in these situations.

While we do create and own the original sources for some of our imagery, photography, graphics and video content, a portion of this content used throughout the site, blog and other content distribution channels of Vesper Digital Media and Digital Codec are purchased stock resources or ethically sourced free stock resources.


We do our due diligence to follow any applicable usage rules of the Stock content we utilize and ensure anything we download gives us the right to edit, crop and distribute on our website and across other content distribution channels. We are very careful to always either create content ourselves or legally source it and follow the rules to the best of our ability and knowledge.


We are well versed in legal compliance, copyright law, and review the usage rules of all the websites and sources we procure quality stock content from to ensure we are compliant and above board. We know better than to ever download random images from Google image sources and even qualify the usability and licencing of logo graphics for other companies and platforms before utilizing them in our content.

We do our due diligence to inform our direct web design clients on copyright laws, stock usage rules and ethical sourcing practices for content used on their websites, blogs and other content verticals as we create and design content on their behalf. Any content we directly created on their behalf will be above board and follow usage rules for stock and sourcing it appropriately to a T as legal and ethical sourcing of stock content is incredibly important to us.


However in the case they didn't follow our advice after full control of the site was turned over, or provided content they didn't own to us as their own under false pretext,  we cannot be held liable.


We also cannot be liable for any content, images, video and other content they post that that they don't have the rights to after we've completed their website and turned over ownership, access and control when the site launched.

Vesper Digital Media contains relevant affiliate links for products, services, and platforms that are mentioned within the content of our site's blog and newsletter, collectively called Digital Codec.


Please be aware we may receive a commission if you make a purchase after clicking on one of these links. It is no additional cost to you, and is simply a profit sharing incentive to affiliate partners like us to share our links with our Audience, Clients & User Base.

Vesper Digital Media and Digital Codec will never put an affiliate link for a product we haven't tried or used ourselves. We will always check to ensure every product, service and platform fulfills it's core usability promises at the time of our utilizing it.


We take checking the quality of any linked products, services etc. seriously and this is even more so in regards to our affiliates as our core goal is to be of service to our audience and only suggest tools, services, etc. that are valuable for different use cases honestly and ethically.


If we are covering a product or service that doesn't quite stack up to our metrics, we may still direct link it as for other use cases or workflow styles they still may be useful, but will be honest about our opinions and  use cases in which another option may be more effective.


This way you can trust what we put forth on Digital Codec as being tested and found to be of quality or at least that we'll give our honest opinion regarding best use cases.

Affiliate Disclosure Links, Programs, Services and Platforms are Subject to Change, Update & Removal

The usability and accessibility of products, services, programs etc. are, of course, subject to change over time.


Sometimes at the time of originally posting a piece of content mentioning relevant products, services, and platforms there may not be an available program for some or all of them, or we may not have been approved for their associated affiliate programs yet as qualifications can vary widely from program to program.


If an affiliate program does become available later, and we choose to apply to join it and become approved at a later date we reserve the right to update old articles and videos to include the affiliate links with the appropriate and legally compliant notice that it is now a paid affiliate link using the formatting outlined in the following section.


If a follower informs us the quality has fallen, or we have come to find a product, service, or program we put forth previously is no longer in the same condition we originally put it forward in, those links may be removed until they are brought back up to the expected quality.


There are cases where it may never be added back or left off indefinitely if the product, service, or program is no longer being maintained or was taken offline. In the case of it being removed we will add a notice to make it clear that since the posting of the content originally that product, service, or program has gone offline. If a new contender that fills that need comes along we will will add a link to that information as well to avoid dead ends where possible and best serve our audience.


Another common situation is that platforms and therefore appropriate methods and strategies can change overtime, and often programs or information products cannot keep pace.


 With our own information products we will do our best to ensure we update them in a reasonable time frame and update you all, as this is a core goal with Digital Codec -  to keep everyone informed as platforms and strategies change over time so they can be nimble in their businesses and strategy.


We reserve the right to remove any affiliate  offers or direct links to external information that is no longer accurate if they fail to update it in a timely manner to ensure quality for our followers, clients and user base. A note that the information may no longer match the current version of the platform it is for may be placed during that grace period as a notice to our following to be aware and keep an eye on it.


Please note that individual companies running their affiliate programs can choose to end them at any time. In this case as well we reserve the right to remove affiliate links at will as they become broken or defunct.


If the product, service or platform itself still remains available and of the expected quality we will still provide a clickable direct link to purchase for our audience's convenience and ease of use. That link will no longer have the affiliate disclaimer, because it would no longer be an affiliate link.

Regular links that aren't affiliates simply are clickable links in the style with the rest of our site without the 'Paid Link' designation.


For further clarification, we are only paid if you click through our link, and complete purchase. This of course is of no burden to you as we are sharing some of the profit with the seller in exchange for sharing their product, service or platform with our audience.



It is your right to choose if you want to click our link and let us earn a referral for it, or go to the product, service or platform on your own to make your purchase. Either way it is no hard feelings if you decide not to use our link. It is of course appreciated if you do choose to do so as it supports our work on Digital Codec, but you are under no obligation to do so.

Affiliate Disclosure Affiliate Cookies, Common Active Period & How to Remove Cookies

The associated tracking codes for affiliate programs, also called 'cookies' are commonly utilized online to attribute sales on the linked site to the appropriate affiliate.


Affiliate Cookies in particular are time-sensitive and the common timing for cookies to remain on your browser will last between 30-90 days. The timing can differ in rare outlier cases and be shorter or longer than the standard 30-90 days. As an example ranging from 10 days or 125 days - or sometimes longer depending on individual affiliate program settings.


The cookie's timing is set by the individual entities and companies running their respective affiliate programs and is out of the control for Vesper Digital Media and Digital Codec. It is also not possible to inform you of the cookie length for each individual affiliate link on our blog that you may come across.


Remember you can always choose to clear your cookies manually at any time should you desire to do so. There are also options with some browsers and systems to regularly clear cookies via an automated cycle.
